Yes. Zambian law recognises electronic signatures, but the legal effect and evidential strength depend on the type of signature, the circumstances of the transaction and the reliability of the method used.

This guide explains what the Electronic Communications and Transactions Act No. 4 of 2021 actually requires, how electronic evidence is assessed, and where electronic execution may not be appropriate.

PRIMARY LEGISLATION

The Four Cornerstones of the Electronic Communications and Transactions Act No. 4 of 2021

Enacted by the Parliament of Zambia, the Act provides the statutory architecture governing electronic commerce, signatures, and admissibility of data messages.

SECTION 6

Advanced Electronic Signatures

Where a law requires a signature and does not specify the type, the Act provides for an advanced electronic signature.

Statutory Standard: Applicable where formal legal requirements dictate heightened signing controls.
SECTION 7

Reliability & Attribution

Where parties require an electronic signature but have not agreed the method, the method must identify the person, indicate their approval and be reliable and appropriate for the circumstances.

Section 7(3): Provides a rebuttable presumption where an advanced electronic signature is used.
SECTION 8

Originality & Integrity

Deals with whether an electronic record can satisfy a requirement for information to be presented or retained in original form, including whether it has remained complete and unaltered.

Integrity Standard: Cryptographic document sealing protects unaltered preservation.
SECTION 9

Admissibility & Evidential Weight

Electronic records cannot be excluded merely because they are data messages; courts consider factors such as how the record was generated, stored and communicated.

Evidential Weight: Assessed based on the documented reliability of the execution method.
FORENSIC & EVIDENTIARY COMPARISON

A Signature Image Is Not the Same as Evidence of Execution

Many organisations mistake a pasted bitmap of handwriting on a PDF for a legally defensible digital transaction. The evidentiary differences are substantial.

GRAPHICAL SIGNATURE IMAGE EVIDENTIALLY VULNERABLE

Scanned Signature Image

  • Shows an image of handwriting;
  • May not establish who applied it;
  • A scanned signature image does not, by itself, establish when or how the signature was applied;
  • May not show whether the file changed afterward;
  • Can be copied or reused without the image itself proving who applied it.
AUDITABLE SIGNATURE PROCESS AUDITABLE CONTROLS

Structured Electronic-Signature Process

  • Can record authentication events (such as SMS OTP or corporate email verification);
  • Can retain execution timestamps cryptographically associated with the signing event;
  • Can preserve audit information such as authentication events, timestamps and signatory identifiers, depending on configuration;
  • Can support integrity verification through cryptographic signing and document-integrity controls.
STATUTORY SCOPE & RESTRICTIONS

Transactions That Require Special Legal Treatment

Section 3(2) of the Electronic Communications and Transactions Act No. 4 of 2021 explicitly specifies transactions to which the Act does not apply.

Wills & Testamentary Dispositions

The execution of a will or any other testamentary disposition remains governed by physical formal execution under the Wills and Administration of Testate Estates Act.

Trusts & Powers of Attorney

The creation, performance or enforcement of an indenture, declaration of trust or power of attorney (with the exception of constructive, resulting and implied trusts).

SCHEDULE ITEM 3

Sale of Immovable Property

Contracts for the sale or conveyance of immovable property or any interest in such property continue under formal land conveyancing statutes.

SCHEDULE ITEM 4

Transfer of Real Property Interest

The formal transfer of any interest in immovable property registered under the Lands and Deeds Registry Act.

Section 3(3) Statutory Gate: Section 3 of the Act itself makes clear that other written laws may prescribe how particular information, documents or signatures must be transmitted, stored or retained.
Commercial Scope: Many routine commercial, employment, procurement and operational documents can be executed electronically, subject to the applicable statutory, contractual and sector-specific requirements.
