SECTION 6 • STATUTORY REQUIREMENT

Advanced Electronic Signatures

Where a law requires a signature and does not specify the type, the Act provides for an advanced electronic signature. Under Section 6(2), an AES must be uniquely linked to the signatory, capable of identifying them, created under their sole control, and linked so that subsequent alteration is detectable.

SECTION 7(3) • EVIDENTIARY PRESUMPTION

Rebuttable Legal Presumption

Where an advanced electronic signature is used, Section 7(3) of the Act provides a statutory rebuttable presumption that the signature was validly applied and that the signatory intended to approve the contents, shifting the evidentiary burden under scrutiny.

SECTION 9 • EVIDENTIAL WEIGHT

Admissibility & Evidential Weight

Electronic records cannot be denied admissibility in legal proceedings solely because they are electronic. Courts assess evidential weight based on the reliability of the manner in which the record was generated, stored, and communicated, and how the signatory was identified.
